PrivacyEngine’s AI Act Authority Tracker provides a clear, country-by-country view of the competent authorities responsible for implementing and enforcing the EU Artificial Intelligence Act. It covers national competent authorities, market surveillance and notifying authorities, as well as national bodies protecting fundamental rights, and indicates each authority’s current designation status: officially designated, identified in draft legislation or other formal communications but pending designation, or not yet identified. In line with the AI Act, EU Member States were required to designate or establish their national competent authorities by 2 August 2025, making timely oversight essential for governance, risk, and compliance planning. This tracker is based on publicly available information as of mid-July 2025 and is updated as Member States confirm or change designations. EU Institutions
Under the EU AI Act, the European Data Protection Supervisor (EDPS) is the designated competent authority, serving as both the market surveillance authority and the notifying authority for AI systems used or deployed by EU institutions, agencies, offices, and bodies. In addition, the EU AI Office exercises market surveillance powers over AI systems built on a general-purpose AI (GPAI) model when the same provider develops both the model and the downstream system.

EU’s central authority for implementing the AI Act, overseeing safe and compliant deployment of general-purpose AI, and cultivating an ecosystem of trustworthy, human-centred artificial intelligence.
European Data Protection Supervisor
Independent EU authority safeguarding fundamental rights and data protection; under the AI Act, the EDPS supervises EU institutions’ use of AI as the competent authority, with power to enforce and fine non-compliance.
EU member states
National competent authorities and authorities protecting fundamental rights
Under the EU AI Act, each Member State must designate national competent authorities to implement and enforce the rules. At a minimum, this includes: (1) at least one market surveillance authority to monitor compliance, investigate risks, and apply corrective measures; and (2) at least one notifying authority to designate and oversee notified bodies that perform conformity assessments. States may assign these roles to existing regulators or create new ones and may appoint more than one of each to fit national structures.
In parallel, every Member State must identify authorities protecting fundamental rights (e.g., data protection authorities, equality bodies, national human rights institutions). These bodies help ensure that high-risk AI systems comply with EU fundamental-rights law, handle complaints and redress, and cooperate with market surveillance authorities and the European AI Office to deliver coherent, effective enforcement.
